1. Introduction

Welcome to Translason (“Service”, “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Translason’s translation services, including our API, website, and any associated services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Definitions

  • Service: Translason’s JSON translation API, website (translason.com), and related services
  • User/Customer: Any individual or entity accessing or using the Service
  • API Token: Unique authentication credentials provided for Service access
  • Content: Any data, including JSON structures, submitted to our Service
  • Translation: Any output, including translated text, produced by our Service
  • Character: A single letter, number, symbol, or space in the submitted content
  • Free Tier: Limited service access provided without charge
  • Paid Tier: Service access requiring payment based on usage

3. Account and API Token Security

3.1 Registration Requirements

  • You must be at least 18 years old to use the Service
  • You must provide accurate, complete, and current registration information
  • You must have the legal authority to enter into these Terms
  • You must provide a valid email address for account-related communications
  • You must not create accounts using automated methods

3.2 API Token Security

  • Each API token is unique, confidential, and non-transferable
  • You are responsible for maintaining the security of your API token
  • You must not share, sell, or lease your API token
  • You must implement industry-standard security practices when storing tokens
  • You must not embed API tokens in client-side code or public repositories
  • You must use environment variables or secure key management systems
  • You must rotate compromised tokens immediately

3.3 Security Obligations

  • You must notify us immediately of any unauthorized token use
  • You must notify us of any suspected security breaches
  • You must implement reasonable security measures in your applications
  • You must encrypt data in transit when using our Service
  • You must not attempt to bypass or decode our authentication mechanisms

4. Service Usage and Restrictions

4.1 Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Translate content you don’t have rights to
  • Submit malicious code or attempt to test vulnerabilities
  • Conduct denial of service attacks
  • Exceed or circumvent rate limits
  • Reverse engineer the Service
  • Compete directly with our Service
  • Resell or redistribute our Service without written permission

4.2 Technical Restrictions

  • Maximum request size: 10,000 characters per string
  • Maximum concurrent requests: Based on tier (Free: 5, Paid: 15)
  • Rate limits per minute: Based on tier (Free: 10, Paid: 30)
  • Maximum requests per day: Based on tier (Free: 1,000, Paid: 5,000)
  • Maximum payload size: 1MB
  • Supported formats: Valid JSON only
  • Maximum nesting depth: 32 levels

4.3 Content Guidelines

You must not submit content that:

  • Is illegal or promotes illegal activities
  • Infringes on intellectual property rights
  • Contains malware or malicious code
  • Contains personally identifiable information (PII)
  • Violates privacy or data protection laws
  • Is intended to harm or exploit users
  • Contains hate speech or discriminatory content

5. Pricing and Payment

5.1 Pricing Structure

  • Base rate: $0.30 per 1 million characters
  • Characters are counted based on translatable content only
  • Non-charged elements include:
    • JSON keys
    • Numbers
    • Boolean values
    • Null values
    • URLs
    • Email addresses
    • Technical identifiers
    • Whitespace in technical elements
    • Special characters in technical elements

5.2 Free Tier Limitations

  • 100,000 characters per month
  • Resets on the 1st of each month
  • No rollover of unused characters
  • Basic rate limiting applies
  • No SLA guarantees
  • Community support only

5.3 Payment Terms

  • Payment required for usage beyond free tier
  • Billing occurs monthly in arrears
  • Payments processed via Paddle
  • All fees are non-refundable, but characters for invalid translations are counted back
  • Failed payments may result in service interruption
  • Chargebacks may result in account termination

5.4 Pricing Changes

  • 30 days notice for price increases
  • Price increases won’t affect prepaid credits
  • Immediate effect for price decreases
  • Enterprise contracts maintain agreed rates

6. Data Processing and Privacy

6.1 Data Processing

  • Content is processed solely for translation purposes
  • No persistent storage of translated content
  • Temporary caching limited to processing duration
  • No training of AI models on your content
  • No human review of content unless explicitly requested
  • No use of content for service improvements
  • No access to content by employees except for support

6.2 Data Collection

We collect and store:

  • API token usage metrics
  • Request timestamps
  • IP addresses
  • Error logs
  • Character counts
  • Language pairs
  • Response times
  • Billing information

6.3 Security Measures

  • TLS 1.3 encryption for all API traffic
  • AES-256 encryption for stored data
  • Regular security audits
  • Automated vulnerability scanning
  • Access controls and audit logging
  • Employee security training
  • Incident response procedures

7. Service Level Agreement (SLA)

7.1 Uptime Commitment

  • Target uptime: 99.9%
  • Measured monthly
  • Excludes scheduled maintenance
  • Excludes force majeure events

7.2 Performance Metrics

  • API response time: < 500ms (95th percentile)
  • Error rate: < 0.1%
  • Success rate: > 99.9%

7.3 Maintenance Windows

  • Scheduled maintenance: Sundays 00:00-04:00 UTC
  • Emergency maintenance as required
  • Notification:
    • 7 days for scheduled maintenance
    • Best effort for emergency maintenance

7.4 Support Response Times

Free Tier:

  • Initial response: < 48 hours
  • Best effort resolution

Paid Tier:

  • Initial response: < 4 hours
  • Technical resolution: < 24 hours
  • Emergency response: < 1 hour

8. Intellectual Property Rights

8.1 Service Ownership

  • We retain all rights to:
    • Service infrastructure
    • API design
    • Documentation
    • Translation algorithms
    • Website content
    • Brand assets

8.2 Content Rights

  • You retain all rights to your content
  • You grant us limited license to process content
  • You own all translation outputs
  • You warrant you have rights to translate content

8.3 Feedback License

  • We may use your feedback to improve the Service
  • You grant us perpetual license to use feedback
  • We may implement similar features suggested by others
  • We don’t compensate for feedback or suggestions

9. Warranty and Liability

9.1 Service Warranty Disclaimers

  • Service provided “as is”
  • No guarantee of translation accuracy
  • No warranty of uninterrupted service
  • No warranty of fitness for purpose
  • No warranty of translation quality
  • No warranty regarding third-party services

9.2 Limitation of Liability

  • Liability limited to fees paid in last 12 months
  • No liability for:
    • Indirect damages
    • Lost profits
    • Data loss
    • Business interruption
    • Translation errors
    • Service interruptions
    • Third-party claims
    • Force majeure events

10. Term and Termination

10.1 Term

  • Terms effective upon Service use
  • Continues until terminated
  • Survival of applicable provisions

10.2 Termination by User

  • Cancel account at any time
  • Delete API tokens
  • Pay outstanding balances
  • No refunds for prepaid amounts

10.3 Termination by Us

We may terminate or suspend access:

  • For Terms violations
  • For payment failures
  • For security concerns
  • For service abuse
  • For illegal activities
  • At our discretion with notice

10.4 Effect of Termination

  • Immediate access termination
  • Payment obligations survive
  • Data deletion within 30 days
  • No liability for data loss
  • Confidentiality obligations survive

11. Changes to Terms

11.1 Modifications

  • We may modify Terms at any time
  • Notice provided via:
    • Email
    • Service dashboard
    • Website announcement
  • 30 days notice for material changes
  • Immediate effect for non-material changes

11.2 Acceptance

  • Continued use implies acceptance
  • Objections must be made in writing
  • Termination option if changes unacceptable

12. Dispute Resolution

12.1 Informal Resolution

  • Good faith negotiation required
  • 30 days informal resolution period
  • Written notice of disputes required

12.2 Arbitration

  • Binding arbitration for unresolved disputes
  • JAMS rules apply
  • Individual basis only
  • No class actions
  • Location: Ukraine
  • Language: English

12.3 Exceptions

  • Intellectual property disputes
  • Injunctive relief
  • Small claims court cases

13. General Provisions

13.1 Governing Law

  • Laws of Ukraine apply
  • Excluding conflicts of law principles
  • UN Convention on Contracts excluded

13.2 Severability

  • Invalid provisions severable
  • Remaining provisions enforceable
  • Replacement preserving intent

13.3 Assignment

  • We may assign our rights
  • You may not assign without consent
  • Mergers and acquisitions permitted

13.4 Force Majeure

  • No liability for events beyond control
  • Including but not limited to:
    • Natural disasters
    • War or terrorism
    • Pandemics
    • Government actions
    • Network failures
    • Third-party service failures

14. Acknowledgment

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
